Abstract

The subject of the paper is an analysis of the resolution of the Supreme Court of December 7, 2021, III CZP 67/20, in which the Court found it admissible for the guardianship court to issue a decision to prepare a new birth certificate for the child in the event of a final denial of the paternity of the mother’s husband. At the same time, the Court indicated that the person concerned in this type of case will also be the man whose paternity is denied. If he is not a participant in the proceedings, the court should summon him to take part in the case.
